FOIL Appeals and Administrative Silence

Transparent Law Enforcement is documenting how public agencies handle administrative FOIL appeals, constructive denials, delayed determinations, and required notices to oversight bodies.

This project began with Monroe County agencies but concerns a broader statewide issue: whether FOIL appeal rights function in practice when agencies do not respond, do not issue determinations, or do not create a clear administrative record.

This hub will collect timelines, source records, agency responses, Committee on Open Government (COOG) related records, appeal examples, and analysis as the project develops.

Why the Committee on Open Government Matters

New York’s FOIL appeal regulations require agencies to transmit appeals and appeal determinations to the Committee on Open Government. When agencies do not create or transmit those records, COOG cannot see the full appeal picture and the public record becomes incomplete.
